The Montgomery County Court rejected the defense counsel’s argument that the commonwealth was unable to establish that Foote’s conduct rose “to the level of recklessness or gross negligence” required to support the homicide charges or “willful or wanton disregard for the safety of person or property” to support a reckless driving charge. The Court convicted the defendant for the charge of reckless driving.
